If your business owns or licenses personal information about a Massachusetts resident, it must comply with 201 CMR 17.00. The regulation has been in effect since March 1, 2010, and it applies wherever your business is located, not just to firms based in the Commonwealth. Personal information is defined narrowly in the regulation: a resident’s name together with a Social Security number, a driver’s license or state ID number, or a financial account, credit card, or debit card number that would permit access to the account.
Among other things, the regulation asks you to keep a comprehensive information security program in writing, name an employee responsible for it, assess your risks, review the program at least annually, and oversee the third-party providers who handle that data. Where personal information is stored or sent electronically, section 17.04 adds eight technical controls, each required to the extent it is technically feasible:
